2. USE OF OUR WEBSITE
You may use this website for lawful purposes only.
When creating an account, placing an order or providing information through our website, you agree to provide information that is accurate, current and complete.
Where a customer account is created, you are responsible for maintaining the confidentiality of your account credentials.
You may not misuse our website, attempt to interfere with its operation, introduce malicious software, access areas without authorisation or use the website in a way that violates applicable law or the rights of others.
We may restrict or suspend access to the website where reasonably necessary for security, fraud prevention, technical maintenance, legal compliance or suspected unlawful activity.
3. PRODUCTS
CORLIS ATELIER curates products offered through our online store.
We make reasonable efforts to ensure that product descriptions, photographs, materials, dimensions, colours and other information displayed on our website are accurate.
However, colours and appearance may vary slightly depending on photography, lighting, screen settings, manufacturing tolerances and the device being used.
Customers should review the complete product description before placing an order.
Product availability may change without notice.
Displaying a product on our website does not guarantee that it will remain available.
We reserve the right to discontinue products or limit available quantities, provided that doing so does not affect orders already accepted by us.
4. PRODUCT SAFETY AND COMPLIANCE
Products offered for sale through CORLIS ATELIER must comply with applicable European Union and Portuguese product-safety requirements.
Where required by applicable legislation, product listings will include relevant information such as:
-
Product identification;
-
Manufacturer name and contact information;
-
Details of the responsible economic operator within the European Union where required;
-
Relevant safety information;
-
Warnings or instructions required for the safe use of the product.
Products subject to additional European Union legislation, certification or conformity requirements will only be offered where the applicable requirements have been satisfied.
Nothing in these Terms limits any statutory rights relating to product safety or defective products.
5. THIRD-PARTY FULFILMENT
CORLIS ATELIER may use manufacturers, distributors, logistics companies or other third-party fulfilment partners to store, prepare or dispatch orders.
Some products may therefore be shipped directly to the customer by an authorised fulfilment partner acting on our behalf.
Where CORLIS ATELIER is identified as the seller, the use of a third-party fulfilment partner does not remove or reduce the customer's statutory rights against CORLIS ATELIER.
Actual dispatch locations, processing periods, estimated delivery times and applicable delivery conditions are set out in our Shipping & Delivery Policy and/or communicated before completion of the order.
Where an order contains products dispatched from different locations, products may arrive in separate parcels where applicable.
6. PRICES
Prices displayed to consumers are shown in euros (€), unless clearly stated otherwise.
Prices shown to consumers include applicable taxes where required by law.
Any additional delivery charges or other mandatory charges applicable to an order will be clearly communicated before the customer places the order.
Customers will not be charged additional optional amounts without their express consent.
The total amount payable will be displayed during checkout before the order is submitted.
7. SALES, DISCOUNTS AND PROMOTIONS
Any sale, promotion or announced price reduction will be operated in accordance with applicable Portuguese and European Union pricing rules.
Where legally required, an announced price reduction will use the applicable previous reference price.
For products previously offered for sale, the reference price will generally be based on the lowest price previously applied during the preceding 30 consecutive days, in accordance with Portuguese law.
Promotional conditions, including duration, eligible products or other restrictions, will be clearly communicated where applicable.
CORLIS ATELIER will not artificially increase prices for the purpose of presenting a misleading discount.
8. PLACING AN ORDER
Products displayed on our website constitute an invitation to place an order and do not themselves constitute acceptance of an order.
Before submitting an order, customers will be given the opportunity to review and, where necessary, correct the information entered, including:
-
Products selected;
-
Quantities;
-
Delivery details;
-
Billing details; and
-
Total price.
By completing checkout and activating the button or function indicating an obligation to pay, the customer submits an order and agrees to pay the displayed total amount.
9. ACCEPTANCE OF ORDERS
After an order is submitted, the customer will receive an electronic communication acknowledging receipt of the order.
Receipt of an automated acknowledgement does not necessarily mean that we have accepted the order.
A contract is formed when CORLIS ATELIER accepts the order, as indicated through the applicable order confirmation, payment confirmation or other clear acceptance communication.
We may decline or cancel an order where there is a legitimate reason, including:
-
Product unavailability;
-
A material pricing or technical error;
-
Failure to authorise payment;
-
Suspected fraud;
-
Delivery restrictions;
-
Product-compliance concerns; or
-
Other circumstances that prevent us from lawfully fulfilling the order.
Where payment has already been collected for an order that we cannot accept or fulfil, the applicable amount will be refunded.
10. CONTRACT CONFIRMATION
After conclusion of the contract, CORLIS ATELIER will provide the customer with confirmation of the contract and the applicable contractual information by email or another durable medium within the period required by applicable law.
Customers should retain their order confirmation and these Terms for their records.
11. LANGUAGE AND CONTRACT RECORDS
Contracts through CORLIS ATELIER may be concluded in English and, where the Portuguese version of the store is available, Portuguese.
Before completing an order, customers are able to identify and correct relevant data entered during the checkout process.
Order and contractual information is retained by CORLIS ATELIER in accordance with applicable legal, tax, accounting and record-keeping obligations.
Customers will receive relevant order information electronically.
Where customer-account functionality is available, certain order information may also remain accessible through the customer's account.
12. PAYMENT
Available payment methods are displayed during checkout.
Payments may be processed through Shopify Payments and/or other authorised payment-service providers.
Customers must provide accurate payment and billing information and must be authorised to use the selected payment method.
Payment information may be processed directly by authorised payment providers in accordance with their applicable security and privacy requirements.
CORLIS ATELIER does not receive or retain complete payment-card details where those details are processed directly by an authorised payment provider.
13. SHIPPING AND DELIVERY
Available delivery destinations, estimated delivery periods, shipping methods and applicable delivery charges will be displayed in our Shipping & Delivery Policy and/or communicated before the customer completes an order.
Unless another delivery period has been agreed, goods will be delivered within the time required under applicable law.
Delivery estimates are estimates and may occasionally be affected by circumstances outside our reasonable control.
Where a significant delay occurs, CORLIS ATELIER will inform the customer where appropriate and provide the remedies required by applicable consumer law.
Detailed shipping conditions are available in our Shipping & Delivery Policy.
14. RISK DURING DELIVERY
Where CORLIS ATELIER arranges transport of the goods, the risk of loss or damage remains with CORLIS ATELIER until the consumer, or a third party nominated by the consumer other than the carrier, acquires physical possession of the goods.
If the consumer independently appoints a carrier that was not proposed or offered by CORLIS ATELIER, risk may transfer when the goods are delivered to that carrier, as permitted by applicable law.
15. 14-DAY RIGHT OF WITHDRAWAL
Consumers purchasing goods online generally have the right to withdraw from the contract without giving a reason within 14 days.
For purchases of goods, the withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where multiple goods purchased in a single order are delivered separately, the withdrawal period generally begins when the last applicable item is received.
The consumer must communicate the decision to withdraw before the applicable withdrawal period expires.
16. HOW TO EXERCISE THE RIGHT OF WITHDRAWAL
A consumer may exercise the statutory right of withdrawal using:
-
The withdrawal/cancellation functionality provided through our website where available or legally required;
-
The statutory model withdrawal form where applicable; or
-
Any other clear and unequivocal statement informing CORLIS ATELIER of the decision to withdraw.
Where a withdrawal request is submitted electronically through our website, we will provide confirmation of receipt on a durable medium, such as email, as required by applicable law.
Detailed instructions are provided in our Returns & Refunds Policy.
17. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal may not apply to certain products or circumstances expressly excluded by law.
Examples may include:
-
Goods made to the consumer's specifications or clearly personalised;
-
Sealed goods which are not suitable for return for health-protection or hygiene reasons where the seal has been removed after delivery; and
-
Other goods falling within a statutory exception.
An exception will only be relied upon where permitted by applicable law.
Where relevant, applicable restrictions will be disclosed to the customer before purchase.
18. RETURNING GOODS AFTER WITHDRAWAL
After exercising the statutory right of withdrawal, the consumer must return the applicable goods without undue delay and, generally, no later than 14 days after communicating the withdrawal.
Return instructions and the applicable return destination will be provided through our Returns & Refunds Policy or directly to the customer.
The consumer may be required to bear the direct cost of returning goods where permitted by law and where the consumer was appropriately informed of this before purchase.
The consumer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning.
The consumer may be responsible for diminished value resulting from handling beyond what is reasonably necessary for such inspection.
19. REFUNDS FOLLOWING WITHDRAWAL
Where a consumer validly exercises the statutory right of withdrawal, CORLIS ATELIER will reimburse the payments required by applicable law.
This will generally include the original standard delivery charge, where applicable.
If the customer selected a delivery method more expensive than our least expensive standard delivery option, we are not required to reimburse the additional amount resulting from that choice where applicable law allows this.
Refunds will generally be made using the same payment method used for the original transaction unless another method is expressly agreed.
No additional fee will be imposed on the consumer merely because a statutory refund is being processed.
Where permitted by law, we may withhold reimbursement until we receive the returned goods or the consumer provides evidence that they have been sent back, whichever occurs first.
Refunds will be completed within the applicable statutory period.
20. LEGAL GUARANTEE OF CONFORMITY
Products purchased by consumers through CORLIS ATELIER benefit from the mandatory legal conformity protections provided under Portuguese and European Union consumer law.
For new consumer goods subject to Portuguese law, CORLIS ATELIER is generally responsible for a lack of conformity that becomes apparent within three years from delivery.
A product must conform to the applicable contract and meet the objective and subjective conformity requirements established by law.
Depending on the circumstances and the rules governing the applicable remedy, consumers may have rights including:
-
Repair;
-
Replacement;
-
Proportionate reduction of the price; or
-
Termination of the contract and refund.
These rights are subject to the requirements, conditions and hierarchy of remedies established by applicable consumer law.
Any commercial warranty offered by a manufacturer, brand or CORLIS ATELIER is additional to the statutory legal guarantee and does not replace it.
Nothing in these Terms excludes or limits the mandatory legal guarantee.
21. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
If an item arrives damaged, incorrect or appears not to conform to the contract, customers should contact CORLIS ATELIER using the contact information provided below.
Customers should provide sufficient information to allow us to identify the order and understand the issue.
This may include photographs where reasonably useful, but requesting photographs does not remove or restrict statutory consumer rights.
Claims relating to lack of conformity are handled separately from the consumer's 14-day right of withdrawal.
22. PRODUCT RECALLS AND SAFETY ISSUES
If CORLIS ATELIER becomes aware that a product may present a safety risk or requires corrective action, we may take appropriate measures including:
-
Suspending sales;
-
Removing the product from the website;
-
Contacting affected customers;
-
Providing safety instructions;
-
Cooperating with manufacturers, suppliers and competent authorities;
-
Withdrawing products from sale; or
-
Organising a product recall where necessary.
Customers should follow safety warnings, care instructions and recall notices relating to purchased products.
23. INTELLECTUAL PROPERTY
Unless otherwise indicated, the CORLIS ATELIER name, branding, website design, original photographs, editorial material, graphics, text and other content created by or for CORLIS ATELIER are owned by or licensed to CORLIS ATELIER and are protected by applicable intellectual-property laws.
Trademarks, product names, photographs and other content belonging to brands, manufacturers or other third parties remain the property of their respective owners.
Nothing on this website transfers ownership of intellectual-property rights to customers or website visitors.
Website content may not be copied, reproduced, distributed or commercially exploited without permission except where permitted by law.
24. THIRD-PARTY SERVICES
We may use third-party service providers in connection with the operation of our store, including providers of:
-
Ecommerce technology;
-
Payment processing;
-
Shipping and logistics;
-
Email services;
-
Analytics;
-
Customer support; and
-
Other operational services.
Use of third-party service providers does not remove or reduce the rights a consumer has against CORLIS ATELIER where CORLIS ATELIER is the seller.
25. SHOPIFY
Our online store is powered by Shopify.
Shopify provides the ecommerce infrastructure and technology used to operate our store.
Unless explicitly stated otherwise, products offered through CORLIS ATELIER are sold by the legal seller identified in Section 1 and not by Shopify.
The contract for the purchase of products is therefore between the customer and CORLIS ATELIER.
26. PRIVACY AND PERSONAL DATA
Personal data is processed in accordance with our Privacy Policy and applicable data-protection legislation, including the General Data Protection Regulation (GDPR) where applicable.
Personal data may be processed by service providers acting on our behalf where necessary to operate the store, process orders, provide customer service, prevent fraud, fulfil legal obligations or provide services requested by the customer.
More detailed information about how personal information is collected, used, stored and shared is provided in our Privacy Policy.
27. COOKIES AND SIMILAR TECHNOLOGIES
Our website may use cookies and similar technologies.
Where consent is legally required for non-essential cookies or similar technologies, those technologies will only be activated in accordance with applicable consent requirements.
Customers can obtain further information and manage applicable preferences through our cookie information and consent-management tools.
28. CUSTOMER REVIEWS AND CONTENT
Where customers are able to submit reviews, photographs, comments or other content, they must ensure that the content is lawful and does not infringe the rights of another person.
Reviews must reflect genuine experiences and must not contain misleading, fraudulent, unlawful, abusive or infringing material.
Where CORLIS ATELIER publishes customer reviews and applicable law requires information about how the authenticity of reviews is verified, we will provide that information clearly.
We may remove content where reasonably necessary to comply with law, protect third-party rights or maintain the integrity of our website.
29. WEBSITE ERRORS
We take reasonable steps to keep product descriptions, prices, availability and other website information accurate.
Occasionally, genuine technical, typographical or administrative errors may occur.
We may correct such errors.
Where an error materially affects an order already submitted or accepted, we will communicate with the customer and handle the matter in accordance with applicable contract and consumer law.
Nothing in this section gives CORLIS ATELIER the right to unilaterally remove or restrict mandatory consumer rights.
30. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms limits mandatory consumer rights concerning:
-
Product conformity;
-
Product safety;
-
Fraud or fraudulent misrepresentation;
-
Intentional misconduct;
-
Liability that cannot legally be excluded or limited; or
-
Other mandatory rights under Portuguese or European Union law.
Where liability may lawfully be limited, any limitation relied upon by CORLIS ATELIER will be interpreted and applied in accordance with mandatory consumer-protection law.
31. EVENTS OUTSIDE OUR REASONABLE CONTROL
CORLIS ATELIER will not be responsible for failure or delay caused by events genuinely outside our reasonable control to the extent permitted by law.
Such circumstances may include significant transport disruption, natural disasters, government restrictions or major failures of essential infrastructure.
This clause does not remove statutory rights that consumers may have where an order is not delivered or otherwise not performed within the period required by applicable law.
32. COMPLAINTS
Customers who have a complaint about an order, product or service should first contact us using the contact details below.
We will attempt to handle complaints fairly and within a reasonable period.
Customers may also use the Livro de Reclamações Eletrónico where applicable.
Access to the official Electronic Complaints Book will be made available through our website as required by Portuguese law.
33. ALTERNATIVE CONSUMER DISPUTE RESOLUTION
In accordance with Portuguese consumer law, consumers may use an applicable Alternative Consumer Dispute Resolution entity (Entidade de Resolução Alternativa de Litígios de Consumo – RAL).
For consumer contracts falling within its territorial and material jurisdiction, the relevant entity for the Lisbon Metropolitan Area, including Cascais, is:
Centro de Arbitragem de Conflitos de Consumo de Lisboa — CACCL
Consumers can obtain information about this and other recognised consumer dispute-resolution entities through the official Portuguese consumer portal.
Use of an RAL entity is subject to its applicable jurisdiction, rules and statutory requirements.
Where mandatory arbitration applies under Portuguese law, CORLIS ATELIER will comply with the applicable requirements.
34. GOVERNING LAW
These Terms and contracts entered into with CORLIS ATELIER are governed by Portuguese law.
If the customer is a consumer residing in another European Union or European Economic Area country, this choice of Portuguese law does not deprive that consumer of mandatory protections provided by the laws that would otherwise apply to them.
Nothing in these Terms restricts a consumer's right to bring proceedings before a court having jurisdiction under applicable Portuguese or European Union law.
35. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with applicable law.
The remaining provisions will continue to apply.
36. CHANGES TO THESE TERMS
We may update these Terms where necessary to reflect changes in:
-
Applicable law;
-
Our business;
-
Website functionality;
-
Products or services; or
-
Operational requirements.
The Terms applicable to a purchase will normally be those in force when the order was placed, unless a subsequent provision is required to apply by law.
Material changes will be communicated where required by applicable law.
